ARTICLE 1 – SCOPE OF APPLICATION

These general terms of use (hereinafter “Terms of Use” or “TOU”) aim to define the rights and obligations of the user (hereinafter the “User”) when using the services offered by Mrs. Sarah DEHLINGER (hereinafter “Mrs. DEHLINGER” or “the Publisher”) through this website (hereinafter the “Site”). Any use of the Site by the User implies full and unconditional acceptance of these TOU. Therefore, the User acknowledges that the Publisher considers the use and navigation of the Site by the User as an acceptance of these TOU from the first use of the Site. Failure to comply with these TOU would engage the User’s responsibility.

ARTICLE 2 – DESCRIPTION OF SERVICES

The service offered by the Publisher consists of the possibility for the User to discover Paris through guided tour itineraries.

ARTICLE 3 – INTELLECTUAL PROPERTY

The Site is the property of Mrs. DEHLINGER, who holds or is the licensee of intellectual property rights and other rights related to both the general structure of the Site and its content (text, graphics, images, videos, photos, databases, fonts, graphic design, visual identity, layout, and other content), to the software and algorithms allowing its operation, to the distinctive signs associated with the operation of the Site. In accordance with the provisions of the Intellectual Property Code, any representation, reproduction, modification, distortion, and/or total or partial exploitation of the Site and/or its content as recalled above by any means and on any medium, without the express and prior authorization of the Publisher, is prohibited. Likewise, any unauthorized use of the Site and/or its content and/or software and/or distinctive signs (such as, in particular, trademarks registered or not yet registered by Mrs. DEHLINGER) owned and/or operated by Mrs. DEHLINGER engages the responsibility of its author on the basis of infringement and/or unfair competition. The User undertakes, in general, not to infringe in any way the rights of Mrs. DEHLINGER.

ARTICLE 4 – PERSONAL DATA

4.1. To order the Service, the User must contact Mrs. DEHLINGER and fill out an information form in which the following data is collected: name, first name, email address, phone number, position, and, if applicable, company name. This data is necessary for connecting Mrs. DEHLINGER and the User and, if necessary, for providing the Service to the User.

4.2. The data is kept for one year.

4.3. In accordance with the European General Data Protection Regulation (“GDPR”) and the French Data Protection Act no. 78-17 of January 6, 1978, as amended, the User has the right to access, rectify, modify, and delete data concerning them upon simple written request addressed to booking@not-a-cliche-paris.com.

4.4. The Publisher implements organizational and security measures to protect the User’s personal data against theft as well as unauthorized access, use, and modification. Technical and organizational measures are taken to ensure that the computer systems supporting the processing of personal data meet Mrs. DEHLINGER’s internal requirements. With the User’s permission, the User is informed that analytics and advertising cookies may also be used by the Publisher to collect or receive information from the Site and use this information to provide audience measurement services and targeted advertising. The User is informed that, in any case, they have the right to object to the use of analytics and advertising cookies by modifying their browser’s configuration.

ARTICLE 5 – APPLICABLE LAW – JURISDICTION

5.1. These TOU are subject to French law.

5.2. Any dispute arising from these general conditions, including their acceptance, validity, interpretation, execution, termination, consequences, and outcomes, falls under the exclusive jurisdiction of the Commercial Court of Paris, notwithstanding emergency procedure, plurality of defendants, and/or pending appeal.
